Minority governments in parliamentary democracies are conventionally considered to be unstable and ineffective aberrations from the principle of majority rule. Through analysis of over 350 postwar governments, the author shows that minority governments are neither exceptional nor unstable but in fact a common feature of parliamentary democracies and frequently perform as well as, or better than, majority coalitions. Using the Italian and Norwegian governments as case studies, he suggests that minority governments are particularly likely to form when parties anticipate competitive (...) elections and when opposition parties are able to influence legislative decisions. As an attempt to document and explain a very common form of government in parliamentary democracies, this book will contribute significantly to the understanding of the importance of electoral competition in democratic politics. In Roper v. Simmons (2005) the United States Supreme Court announced a paradigm shift in jurisprudence. Drawing specifically on mounting scientific evidence that adolescents are qualitatively different from adults in their decision-making capacities, the Supreme Court recognized that adolescents are not adults in all but age. The Court concluded that the overwhelming weight of the psychological and neurophysiological data regarding brain maturation supports the conclusion that adolescents are qualitatively different types of agents than adult persons. The Supreme Court further solidified (...) its position regarding adolescents as less than fully mature and responsible decisionmakers in Graham v. Florida (2010) and Miller v. Alabama (2012). In each case, the Court concluded that the scientific evidence does not support the conclusion that children under 18 years of age possess adult capacities for personal agency, rationality, and mature choice. This study explores the implications of the Supreme Court decisions in Roper v. Simmons, Graham v. Florida, and Miller v. Alabama for the “mature minor” standard for medical decision making. It argues that the Supreme Court’s holdings in Roper, Graham, and Miller require no less than a radical reassessment of how healthcare institutions, courts of law, and public policy are obliged to regard minors as medical decisionmakers. BackgroundCodes of conduct mainly focus on research misconduct that takes the form of fabrication, falsification, and plagiarism. However, at the aggregate level, lesser forms of research misbehavior may be more important due to their much higher prevalence. Little is known about what the most frequent research misbehaviors are and what their impact is if they occur.MethodsA survey was conducted among 1353 attendees of international research integrity conferences. They were asked to score 60 research misbehaviors according to their views on and (...) perceptions of the frequency of occurrence, preventability, impact on truth (validity), and impact on trust between scientists on 5-point scales. We expressed the aggregate level impact as the product of frequency scores and truth, trust and preventability scores, respectively. We ranked misbehaviors based on mean scores. Additionally, relevant demographic and professional background information was collected from participants.ResultsResponse was 17% of those who were sent the invitational email and 33% of those who opened it. The rankings suggest that selective reporting, selective citing, and flaws in quality assurance and mentoring are viewed as the major problems of modern research. The “deadly sins” of fabrication and falsification ranked highest on the impact on truth but low to moderate on aggregate level impact on truth, due to their low estimated frequency. Plagiarism is thought to be common but to have little impact on truth although it ranked high on aggregate level impact on trust.ConclusionsWe designed a comprehensive list of 60 major and minor research misbehaviors. Our respondents were much more concerned over sloppy science than about scientific fraud (FFP). In the fostering of responsible conduct of research, we recommend to develop interventions that actively discourage the high ranking misbehaviors from our study. (shrink)

Objective theories of human well-being typically focus on goods such as friendship, knowledge, autonomy, and achievement that are realized by everyone or almost everyone, are realized often in life, and are typically quite important to people. In this paper, I defend the possibility of minor objective goods—goods that still benefit people independently of their subjective attitudes toward them, but which are somewhat less prominent in life. Some examples are experiences of humor, care for young children, care for animals, engagement (...) with nature, and engagement with places or objects of cultural significance. I argue that these goods can be defended in the same way as more widely-recognized objective goods—by appealing to considered judgments about well-being. I further argue that there is no reason to rule out a long list of goods and that the minor goods I have mentioned cannot be subsumed under other recognized objective goods. Even thinkers who endorse a connection between human flourishing and human well-being should affirm the goods I have listed, since these goods can be defended as part of human flourishing. (shrink)

Several of these studies have also shown that the actual use of advance directives is significantly lower than this enthusiasm would suggest, but they have not explained the apparent discordance. Nor have researchers explained why members of minority groups are much less likely to complete advance directives than are white patients. In this study, we used a focus (...) group methodology to examine the ways in which diverse populations of patients view the medical, philosophical, and practical issues surrounding advance directives. We were motivated by the significantly lower prevalence of advance directives among African-American and Hispanic patients at one urban teaching hospital (18% for Caucasians, 4% for African-Americans, and 2% for Hispanics). Our premise was that African-American and Hispanic populations, who have had higher rates of morbidity and mortality across numerous disease categories, and historically have had limited access to care and opportunities to discuss health concerns, may be more suspicious about the right of autonomy that an advance directive is designed to ensure. Seven hundred adolescents with mean age of 15.3 years. Multigroup confirmatory factor analysis was performed to assess measurement invariance of the MSPSS scale across Chinese and South Asian ethnic minority samples. Results show that the original three-factor structure of the MSPSS was supported in both samples. Measurement invariance was supported in terms of configural, metric, and partial scalar invariance. Given partial scalar invariance was achieved, the latent mean differences were compared across samples. Chinese adolescents had higher levels of all three (...) types of social support when compared with their South Asian ethnic minority counterparts. The present study attempts to assess the measurement invariance of the MSPSS across ethnic groups in Asian society, which sheds light on future research that involves perceived social support among adolescents in Chinese culture contexts. Background: Black, Asian and minority ethnic groups have a high need for organ transplantation but deceased donation is low. This restricts the availability of well-matched organs and results in relatively long waiting times for transplantation, with increased mortality risks. Objective: To identify barriers to organ donor registration and family consent among the BAME population, and to develop and evaluate a training intervention to enhance communication with ethnic minority families and identify impacts on family consent. Methods: Three-phase programme comprising community-based research (...) involving two systematic reviews examining attitudes and barriers to organ donation and effective interventions followed by 22 focus groups with minority ethnic groups; hospital-based research examining staff practices and influences on family consent through ethics discussion groups with staff, a study on intensive care units and interviews with bereaved ethnic minority families; and development and evaluation of a training package to enhance cultural competence among ICU staff. Setting: Community focus group study in eight London boroughs with high prevalence of ethnic minority populations. Hospital studies at five NHS hospital trusts. Participants: Community studies: 228 focus group participants; hospital studies: 35 nurses, 28 clinicians, 19 hospital chaplains, 25 members of local Organ Donation Committees, 17 bereaved family members; and evaluation: 66 health professionals. Data sources: Focus groups with community residents, systematic reviews, qualitative interviews and observation in ICUs, EDGs with ICU staff, bereaved family interviews and questionnaires for trial evaluation. Review methods: Systematic review and narrative synthesis. Results: Community studies: Organ Donor Register – different ethnic/faith and age groups were at varying points on the ‘pathway’ to organ donor registration, with large numbers lacking knowledge and remaining at a pre-contemplation stage. Key attitudinal barriers were uncertainties regarding religious permissibility, bodily concerns, lack of trust in health professionals and little priority given to registration, with the varying significance of these factors varying by ethnicity/faith and age. National campaigns focusing on ethnic minorities have had limited impact, whereas characteristics of effective educational interventions are being conducted in a familiar environment; addressing the groups’ particular concerns; delivery by trained members of the lay community; and providing immediate access to registration. Interventions are also required to target those at specific stages of the donation pathway. Hospital studies: family consent to donation – many ICU staff, especially junior nurses, described a lack of confidence in communication and supporting ethnic minority families, often reflecting differences in emotional expression, faith and cultural beliefs, and language difficulties. The continuing high proportion of family donation discussions that take place without the collaboration of a specialist nurse for organ donation reflected consultants’ views of their own role in family consent to donation, a lack of trust in SNODs and uncertainties surrounding controlled donations after circulatory death. Hospital chaplains differed in their involvement in ICUs, reflecting their availability/employment status, personal interests and the practices of ICU staff. Evaluation: professional development package – a digital versatile disk-based training package was developed to promote confidence and skills in cross-cultural communication. Initial evaluation produced positive feedback and significant affirmative attitudinal change but no significant difference in consent rate over the short follow-up period with requirements for longer-term evaluation. Limitations: Participants in the focus group study were mainly first-generation migrants of manual socioeconomic groups. It was not permitted to identify non-consenting families for interview with data regarding the consent process were therefore limited to consenting families. Conclusions: The research presents guidance for the effective targeting of donation campaigns focusing on minority ethnic groups and provides the first training package in cultural competence in the NHS. Future work: Greater evaluation is required of community interventions in the UK to enhance knowledge of effective practice and analysis of the experiences of non-consenting ethnic minority families. Minor-attracted persons raise multiple ethical and legal challenges. Sexual contact between adults and children is justly prohibited on child welfare grounds. Advances in technology raise the prospect of interventions for minor-attracted persons that have the potential to reduce harm to children by diverting would-be offenders to other endeavors that nonetheless may generate moral disgust This essay examines three of these potential harm reduction technologies (sex robots, haptic devices and synthetic child pornography) and raises the possibility that their use (...) can be justified and their acceptance morally obligatory if doing so reduces harm to real children. I argue that Plato’s use of thought experiments anticipate many of the themes discussed by Thomas S. Kuhn’s classic essay, “A Function for Thought Experiments.” Kuhn’s concern is that thought experiments satisfy the condition of verisimilitude. That is, thought experiments must not be conducted merely to alter the conceptual apparatus of the scientist regarding the phenomenon explored, but rather to alter the scientist’s conceptual apparatus for the sake of altering his actions (i.e., practical rationality). Plato, too, is quite concerned with (...) getting interlocutors to appreciate that theory not be separated from practice, and that theory is necessary for the process of effective decision making. Each of the interlocutors presented in the Republic, Apology and Alcibiades Minor are confrontedwith a thought experiment that is designed to effect how they choose to live. Although the three dialogues I discuss illustrate the Kuhnian admonishment against separating theory form practice, many other dialogues in the Platonic corpus echo Kuhn’s concerns. (shrink)

The forced marriage of minors is child abuse, consequently duties exist to stop them. Yet over 14 million forced marriages of minors occur annually in developing countries. The American Bar Association concludes that the problem in the US is significant, widespread but largely ignored, and that few US laws protect minors from forced marriages. Although their best chance of rescue often involves visits to health care providers, US providers show little awareness of this growing problem. Strategies discussed to stop forced (...) marriages include recommendations from the UN, the ABA, and the UK. The author anticipates and responds to criticisms that first, no duty to intervene exists without better laws and practice guidelines; and second, that such marriages are not child abuse in traditions where parental rights or familism allegedly justify them. Recalcitrant disputes among health care providers and patients or their families may signal deep cultural differences about what interventions are needed or about clinicians’s professional duties. These issues arose in relation to a mother’s request for hymenoplasty or revirgination for her minor daughter to enable an overseas, forced marriage and protect her from an honor killing. The American College of Obstetrics and Gynecology committee recommends against members performing a hymenoplasty or other female genital cosmetic surgeries due to a lack (...) of data concerning their safety and efficacy. A key issue in such cases is how to determine what is in the minor’s best interest and the scope of health care moral or professional’s duties. The Best Interests Standard can serve as a powerful moral tool for resolving cross-cultural disputes and identifying needed policy. (shrink)

The current policy of the National Institute of Health designed to increase the participation of women and minorities is radically different from previous policies designed to protect minorities from abuses in research studies. The principal arguments to support this policy are twofold: 1) Increased representation of minorities and women in research would increase the generalizability of research data and allow for valid analyses of differences in subpopulations; and 2) being in a clinical research study is advantageous to participants regardless of (...) the final research study results. It remains unclear whether minorities find these arguments compelling. Instead of telling minorities that participation in research is good for them, the research community should focus on understanding what minority communities want from clinical research and then tailoring the message to meet this need. Persuasive arguments to promote long-term increased representation of minorities in clinical research must come from within minority communities. (shrink)

Inside the interdisciplinary field of Jurilinguistics, the main research has been carried out on state languages like English, French, German or Spanish. However, there is a new reality in today´s world, namely the existence of minority languages that have arisen to an official status as sub-state languages for the law and a limited range of branches of the law to be the own way to express themselves. The jurilinguistical point of view of this new reality requires a new approach to (...) it, mainly focused on both a general framework and the situation of each language. This is the reason for a first attempt to formulate a jurilinguistical general framework and a methodological approach to this new field in combination with the study of a particular case language, the Basque language, in order to describe its characters as a sub-state tool for expressing the Basque law and bijuralism, in accordance with its status as an official language in the Basque Autonomous Community and Navarrese Community, both in the Kingdom of Spain. Summary The article deals with a complex of issues connected with the campaign waged by the Macedonian expeditionary corps in Asia Minor in 336–335 BC. The author clears up the aims set for the advance-guard, its command structure, strength and composition. He also describes the relevant military operations and reveals the reasons both for the Macedonians’ successes in 336 and their failures in 335. The idea is argued that despite the final failures, it is hardly possible to say that (...) the campaign the expeditionary corps conducted ended in its total defeat. Besides, it is noted that those military operations had major significance for Alexander’s campaign in Asia Minor in 334, because a number of preconditions for its full success had been created right in their course. This study documents how multicultural education is constructed and implemented in a local pesantren in Tabanan, Bali, Indonesia, namely PBBI. It demonstrates that the multicultural education in this pesantren is based upon the reality of religious, cultural, ethnic, group, and gender diversity that exists surrounding the pesantren. Teaching and administrative staff of this pesantren consist of Muslims and Hindus. Students come from the different socio-cultural backgrounds. Inclusive and tolerance values are incorporated into the curriculum of the pesantren. Multicultural education in (...) this pesantren has become a strategic instrument for adaptation to the Hindu environment where it is located. The pesantren teaches students how to implement Islamic teaching on pluralism and inclusivism in their daily lives. (shrink)

In Spain, any person under the age of 18 is a minor. Generally, minors lack the legal capacity to take legally binding actions because they are deemed incapable of legally binding consent. Spanish civil law recognises, however, that the child, in accordance with the law and being sufficiently mature, may act for himself. It stands, then, that consent, as expressed by the “sufficiently mature” minor, should be legally valid.

Human immunodeficiency virus and other sexually transmitted infections significantly burden youth 13–24 years of age in the United States. Directly engaging youth in sexual health research is a public health priority and urgently needed to develop targeted, youth-friendly, and culturally relevant HIV/sti prevention interventions. Controversies arise, however, regarding informed assent and consent, parental permission or consent, and the definition of “child”/“minor” as it relates to medical, legal, and ethical issues. In this article, we describe challenges in the human subjects (...) review processes that were undertaken before beginning an HIV/sti prevention research project with sexually active youth in an urban setting. These findings provide important contextual information to facilitate youth sexual health research and care, and Institutional Review Board approval processes with fewer delays. (shrink)

Background: Genetic research involving racial/ethnic populations has novel ethical implications for various stakeholders, but ethical acceptability among stakeholders regarding such research is not clear. Methods: As part of a multifaceted National Institute of Mental Health (NIMH)/National Human Genome Research Institute (NHGRI) funded survey, we used repeated-measures factorial multivariate analysis of variance (MANOVA) to compare the perspectives of institutional review board (IRB) chairs (n = 203), investigators (n = 183), and community members (n = 192) on the ethical acceptability of participating (...) in and reporting of psychiatric genetic research focused on racial/ethnic minority groups. Stakeholder views were assessed with two sets of three questions. Results: All stakeholder groups perceived participation in genetic studies focused on racial/ethnic groups as ethically acceptable and endorsed as ethical any decisions by racial/ethnic minorities to decline to participate in such studies if concerned about possible discrimination/stigmatization based on the study findings. Stakeholders disagreed considerably on the ethical acceptability of researchers or journal editors choosing not to publish genetic study results focused on racial/ethnic minority groups based on potential harm of the study findings. Conclusion: Findings show community and professional stakeholders support participation in genetic research focused on specific racial/ethnic groups but recognize that the results of such studies may contribute to discrimination or stigmatization. Stakeholders differed in their perspectives of investigators and editors in balancing ethical issues intrinsic to advancing science versus minimizing harm to potentially vulnerable populations. Women's small share of professional and managerial occupations compared with their share of the total labor force is examined for the 11 largest racial and ethnic minorities in the United States. Gender-related characteristics—women's labor force participation rates, marital status, and the sex ratio—influence women's share of the top jobs, as do class and ethnic variables such as place of birth, population size, and class of worker. Labor market gender inequality is greatest among the smaller, more affluent minorities, many of whom (...) are recent immigrants to this country. The larger, frequently indigenous, minority groups exhibit less of this kind of inequality. Minority and gender status intersect, so that men monopolize surplus resources among the more affluent minority groups and use these resources to secure a more advantaged labor market position. The moral standing of involuntary sterilization has long been subject to debate but has only recently been looked upon with disfavor. When sterilization of a mentally handicapped minor is entertained, issues of eugenics, medical ethics, and legal precedent specially arise. Ethics consultants and ethics committees have been asked to consider such cases.

I address four major objections that have been advanced against the system of multiparty majority democracy that I proposed as an alternative to Wiredu’s non-party consensual democracy. First, that the system is not durable since it is structured around ill-defined ethnic groups; second, that since it envisions each ethnic group as a semi-autonomous entity, the system undermines the integrative process of nation-building; third, that, as a type of federalism, the system has no precedents on African soil, and consequently, that it (...) is likely to face the problem of imperfect fit; and fourth, that some African ethnic groups are too small to stand as semi-autonomous entities. I then underscore four advantages of my system over Wiredu’s: It honours the right of freedom of association; addresses the problem of the marginalisation of minority ethnic groups; reaps the benefits of both non-party and multiparty democracy; and entrenches the ingredients of consensual democracy.
